**STAGE GEAR HARDWARE RENTALS — DAMAGE WAIVER TERMS** The Damage Waiver Election is incorporated into and made part of the Stage Gear Hardware Rental Agreement. ## What the Damage Waiver Is The Damage Waiver is the simplest protection option. You pay a non-refundable fee equal to 10% of your total hardware rental cost, and in return, Stage Gear waives its right to bill you for covered accidental damage to the equipment up to $20,000. There is no claims process — if covered damage is found during the return inspection, we handle it internally at no additional charge to you. **Important:** The Damage Waiver is not insurance. It is a contractual waiver — Stage Gear agrees not to charge you for covered damage. It does not involve an insurance carrier and cannot be used to recover anything. ## Cost The Damage Waiver fee is 10% of your total hardware rental cost. For example, if your equipment rental totals $2,000, the Damage Waiver fee is $200. The estimated cost is shown at the product level on our website, and the final amount is calculated at checkout based on your full rental term. The Damage Waiver fee is non-refundable once the election is confirmed. It does not reduce or replace rental fees; it is assessed in addition to rental fees. Payment is by credit card (charged at checkout) or check (due prior to shipment). ## What the Damage Waiver Covers The Damage Waiver covers accidental physical damage to equipment that occurs during your rental period while the equipment is in your care. This includes: - Accidental drops or impacts - Damage caused by normal use in a professional theatrical or audio-visual production environment - Breakage that results from careful handling where something simply goes wrong Coverage is subject to a maximum of **$20,000 per rental**. ## What the Damage Waiver Does NOT Cover The following are expressly excluded from the Damage Waiver: - **Theft or loss** — if equipment is stolen or goes missing, you are responsible for the full replacement cost. - **Intentional damage** — damage we determine was caused deliberately. - **Gross negligence** — reckless handling of the equipment. This includes exposing equipment to any liquid or water, using equipment outside the conditions it was designed for, or allowing unqualified people to operate it. - **Liquid or water damage** — contact with any liquid constitutes gross negligence and is not covered. - **Missing items** — accessories, cables, cases, or components not returned to us. - **Improper repacking** — shipping damage caused by failure to repack equipment in its original cases and foam, or use of an unauthorized carrier. - **Damage above $20,000** — you remain responsible for costs above the cap. ## Coverage Cap The Damage Waiver covers up to $20,000 in damage per rental. If the cost of repair or replacement exceeds $20,000, you are responsible for the amount above the cap. ## No Claims Process The Damage Waiver is applied automatically by Stage Gear when covered damage is identified during the return inspection. We'll notify you of any damage found and confirm whether it's covered. You don't need to do anything other than return the equipment. ## Loss of Access on Future Rentals If equipment is returned with significant damage, or if you have a pattern of repeated damage across multiple rentals, Stage Gear reserves the right to deny you the Damage Waiver option on future rentals. We will notify you in writing if this applies. It does not affect the current rental. ## Mid-Rental Dissolution for Gross Negligence If Stage Gear becomes aware that equipment is being used with gross negligence during the rental — for example, if you contact us about water damage — the Damage Waiver dissolves automatically as of the date the gross negligence occurred. We will not revoke a Damage Waiver without cause, and we will not do so simply because damage occurred from a normal accident. ## Protection Plan Election Every Stage Gear rental requires a protection plan. Your order is not confirmed and Equipment is not reserved until a selection is made and payment is completed. You must select one of the following three options: ### Option 1 — Elect the Damage Waiver Damage Waiver Fee: 10% of Total Hardware Rental Cost (non-refundable). Upon payment, BMD waives Customer's liability for covered accidental damage to the Equipment during the Rental Term, up to a maximum of $20,000 per rental, subject to the exclusions and terms set forth in Section 6.1 of the Stage Gear Hardware Rental Agreement. This option does NOT cover: theft, intentional damage, gross negligence (including liquid/water damage), missing items, or shipping damage caused by improper repacking or use of an unauthorized carrier. ### Option 2 — Decline the Damage Waiver and Provide a Certificate of Insurance (COI) By selecting this option, Customer declines the Damage Waiver and agrees to submit a valid Certificate of Insurance meeting all requirements of Section 6.2 of the Stage Gear Hardware Rental Agreement. Equipment will not be shipped until BMD reviews and approves the COI. No additional fee. The COI must be submitted to hello@broadwaymedia.com before the scheduled ship date. Failure to provide an approved COI before the ship date may delay or cancel the rental, and no rental fee refunds will be issued for delays caused by a late or deficient COI submission. See the [COI Requirements page](/legal/coi-requirements) for full details. ### Option 3 — Decline the Damage Waiver and Pay a Security Deposit Security Deposit Amount: 50% of total MSRP replacement value (minimum $1,000 / maximum $10,000). By selecting this option, Customer declines the Damage Waiver and agrees to pay a refundable Security Deposit. The Security Deposit is held by BMD for the duration of the rental and through completion of the Return Inspection, and is refunded (in whole or in part) in accordance with Section 6.3 of the Stage Gear Hardware Rental Agreement. Payment by check: No processing fee. Payment by credit card: a non-refundable 3.5% processing fee applies; deposit refunds are issued by check or ACH — not by credit card reversal. If damage or loss exceeds the deposit amount, Customer remains liable for the outstanding balance — the Security Deposit does not cap Customer's total liability. See the [Security Deposit Terms](/legal/security-deposit) for full details. ## Notice of Terms and Conditions **Please read carefully before signing.** - **Election is irrevocable.** Once a Protection Plan is selected and confirmed, the election cannot be changed. - **No coverage without election.** An order is not confirmed and Equipment is not reserved until a Protection Plan is selected and all required payments are made. - **Damage Waiver is not insurance.** The Damage Waiver is a contractual waiver of BMD's right to seek reimbursement for covered accidental damage. It does not provide insurance coverage and does not cover theft, intentional damage, gross negligence, liquid damage, or missing items. - **24-hour inspection requirement.** Customer must submit the Customer Inspection Form within 24 hours of delivery. Failure to do so constitutes acceptance that Equipment arrived in the condition documented in BMD's Pre-Shipment Inspection, and forfeits any claim that damage was pre-existing. - **Return deadline.** Equipment must be delivered to UPS by 12:00 p.m. in Customer's local time zone on the Return Due Date. Late fees accrue from that deadline.
